EARLY RETIREMENT / REDUNDANCY COMMITTEE

 

Minutes of a meeting held on 30th April, 2018.

 

Present:  Councillor Mrs. R. Nugent-Finn (Chairman); Councillor V.J. Bailey (Vice-Chairman); Councillors Mrs. P. Drake, S.T. Edwards, G. John, Mrs. A. Moore and N.C. Thomas.

 

 

907     MINUTES –

 

RESOLVED – T H A T the minutes of the meeting held on 19th March, 2018 be approved as a correct record.

 

 

908     DECLARATIONS OF INTEREST –

 

No declarations were received.

 

 

909     EXCLUSION OF PRESS AND PUBLIC –

 

RESOLVED – T H A T under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information as defined in Part 4 of Schedule 12A (as amended) of the Act, the relevant paragraphs of the Schedule being referred to in brackets after the minute heading.

 

 

910     DETERMINATION OF REDUNDANCY – P (EXEMPT INFORMATION – PARAGRAPHS 12, 13 AND 14) (MD) –

 

Consideration was given to an application for redundancy within the Directorate of Resources.

 

RESOLVED –

 

(1)       T H A T a statutory redundancy payment be approved with effect from 31st July, 2018 on the basis of Scheme D of the Council’s Early Retirement / Redundancy Scheme and within the financial parameters set out in Appendix A to the report, subject to the individual complying with the Council’s Avoiding Redundancy Procedure and subject to Resolution (2) below.

 

(2)       T H A T should alternative employment be found for P, then Resolution (1) above be revoked, together with any redundancy payment.

 

Reasons for decisions

 

(1)       To support the implementation of the amendments to the Council’s establishment.

 

(2)       To support the Council in achieving the financial efficiencies and organisational changes to maintain sustainable service delivery.

 

 

911     DETERMINATION OF REDUNDANCY FOR M (EXEMPT INFORMATION – PARAGRAPHS 12 AND 14) (DEH) –

 

Consideration was given to an application for redundancy within the Directorate of Environment and Housing. 

 

RESOLVED –

 

(1)       T H A T a discretionary redundancy payment be approved with effect from 31st July, 2018 on the basis of Scheme D of the Council’s Early Retirement / Redundancy Scheme minus the cost to the Council of the pension strain and within the financial parameters set out in Appendix A to the report, subject to the individual complying with the Council’s Avoiding Redundancy Procedure and subject to Resolution (2) below.

 

(2)       T H A T should alternative employment be found for M, then Resolution (1) above be revoked, together with the redundancy payment.

 

Reasons for decisions

 

(1)       In the interests of service costs and to recognise that there was no suitable employment for M in the restructuring of the relevant team.

 

(2)       To comply with the terms of the Council’s Avoiding Redundancy Procedure. 

 

 

912     DETERMINATION OF REDUNDANCY FOR H, C AND J (EXEMPT INFORMATION – PARAGRAPHS 12 AND 14) (DEH) –

 

Consideration was given to three applications for redundancy within the Directorate of Environment and Housing.

 

RESOLVED –

 

(1)       T H A T the appropriate discretionary / statutory redundancy payments as recommended by the officer be approved with effect from 31st July, 2018 on the basis of Scheme D for H, C and J of the Council’s Early Retirement / Redundancy Scheme and within the financial parameters set out in Appendix A to the report, subject to the individuals complying with the Council’s Avoiding Redundancy Procedure and subject to Resolution (2) below.

 

(2)       T H A T should alternative employment be found for H, C and J, then Resolution (1) above be revoked, together with the redundancy payments.

 

 

Reasons for decisions

 

(1)       In the interests of service costs and to recognise that there was no suitable employment for H, C and J in the restructuring of the relevant team.

 

(2)       To comply with the terms of the Council’s Avoiding Redundancy Procedure. 

 

 

913     DETERMINATION OF REDUNDANCY FOR W (EXEMPT INFORMATION – PARAGRAPHS 12 AND 14) (DEH) –

 

Consideration was given to an application for redundancy of one employee within the Directorate of Environment and Housing.

 

RESOLVED –

 

(1)       T H A T a discretionary redundancy payment be approved with effect from 31st July, 2018 on the basis of Scheme D of the Council’s Early Retirement / Redundancy Scheme minus the cost to the Council of the pension strain and within the financial parameters set out in Appendix A to the report, subject to the individual complying with the Council’s Avoiding Redundancy Procedure and subject to Resolution (2) below.

 

(2)       T H A T should alternative employment be found for W, then Resolution (1) above be revoked, together with the redundancy payment.

 

Reasons for decisions

 

(1)       In the interests of the service’s costs and to recognise that there was no suitable employment for W in the respective team restructure.

 

(2)       To comply with the terms of the Council’s Avoiding Redundancy Procedure. 

 

 

914     DETERMINATION OF REDUNDANCY – H (EXEMPT INFORMATION – PARAGRAPHS 12 AND 14) (DEH) –

 

Consideration was given to an application for redundancy within the Directorate of Environment and Housing.

 

RESOLVED –

 

(1)       T H A T a discretionary redundancy payment be approved with effect from 31st July, 2018 on the basis of Scheme E of the Council’s Early Retirement / Redundancy Scheme and within the financial parameters set out in Appendix A to the report, subject to the individual complying with the Council’s Avoiding Redundancy Procedure and subject to Resolution (2) below.

 

(2)       T H A T should alternative employment be found for H, then Resolution (1) above be revoked, together with the redundancy payment.

 

Reasons for decisions

 

(1)       In the interests of the service’s costs and to recognise that there was no suitable employment for H in the new restructured team.

 

(2)       To comply with the terms of the Council’s Avoiding Redundancy Procedure. 

 

 

915     DETERMINATION OF REDUNDANCY FOR S (EXEMPT INFORMATION – PARAGRAPHS 12 AND 14) (DEH) –

 

Consideration was given to an application for a redundancy within the Directorate of Environment and Housing.

 

RESOLVED –

 

(1)       T H A T a discretionary redundancy payment be approved with effect from 31st July, 2018 on the basis of Scheme D of the Council’s Early Retirement / Redundancy Scheme minus the cost to the Council of the pension strain and within the financial parameters set out in Appendix A to the report, subject to the individual complying with the Council’s Avoiding Redundancy Procedure and subject to Resolution (2) below.

 

(2)       T H A T should alternative employment be found for S, then Resolution (1) above be revoked, together with the redundancy payment.

(1)       In the interests of the service’s costs and to recognise that there was no suitable employment for S in the respective team restructure.

 

(2)       To comply with the terms of the Council’s Avoiding Redundancy Procedure. 

 

 

916     DETERMINATION OF REDUNDANCY – D AND M (EXEMPT INFORMATION – PARAGRAPHS 12 AND 14) (DEH) –

 

Consideration was given to two applications for redundancy within the Directorate of Environment and Housing.

 

RESOLVED –

 

(1)       T H A T discretionary redundancy payments be approved with effect from 31st July, 2018 on the basis of Scheme E of the Council’s Early Retirement / Redundancy Scheme and within the financial parameters set out in Appendix A and B to the report, subject to the individuals complying with the Council’s Avoiding Redundancy Procedure and subject to Resolution (2) below.

 

(2)       T H A T should alternative employment be found for D and M, then Resolution (1) above be revoked, together with the redundancy payments.

 

Reasons for decisions

 

(1)       In the interests of the service’s costs and to recognise that there was no suitable employment for both individuals in the newly restructured team.

 

(2)       To comply with the terms of the Council’s Avoiding Redundancy Procedure. 

 

 

 

NOTE: In respect of the Committee’s consideration of Agenda Item Nos. 6 and 9, the Human Resources advisor to the Committee raised a number of issues in respect of the proposed recommendations of the employee in service as detailed in the reports.  The recommendations were subsequently withdrawn by the Head of Service as the preferred recommendations.  The Committee considered the available options and the representations of officers however, the Committee determined that they would proceed and approve the initial officer recommendations as set out in the above reports.
